General Terms and Conditions of Sale


These General Terms and Conditions of Sale (hereinafter the "GTC") apply to all orders placed on the website www.nateoconcept.com, without restriction or reservation, between the seller (hereinafter "the Seller" or "Nateo Concept") and non-professional buyers (hereinafter "the Customer").

This website is operated by the company PJMD Web SAS with a share capital of €20,000, having its registered office at ZAC de Bel Air, 17230 ANDILLY (France), registered in the Registre du Commerce et des Sociétés of La Rochelle under number 890 838 816. The intra-community VAT number is FR 08 890 838 816.

Consequently, any person ordering a product offered for sale on the PJMD Web website fully and entirely agrees to these GTC, which the Customer acknowledges having read prior to placing their order. PJMD Web reserves the right to modify these GTC at any time. However, the GTC applicable to an order placed by the Customer on the website nateoconcept.com are those previously accepted by the Customer at the time of placing their order. For any questions related to online purchases, the Site's Customer Service can be reached by phone at 05 46 01 49 14, Monday to Friday from 10am to 5pm.

ARTICLE 1: ORDER

1. Placing an order

The Customer may order Products by following the procedure described on the website www.nateoconcept.com 24/7. By placing an order on the site, the Customer acknowledges the obligation to pay for the ordered Products if the order has been validated within the limits of available stock. The Customer also acknowledges being fully informed that their agreement to the content of these General Terms and Conditions of Sale (GTC) does not require a handwritten signature, as the order is placed online for the products presented therein. By ticking the box: "I have read and accept the General Terms and Conditions of Sale," the Customer confirms that they have read and accepted these GTC.


2. Order modification

The website's order process allows the Customer to check and correct any errors before the final submission of their order. The Customer acknowledges having taken the time to read and verify their order at each step of the ordering process.

3. Order validation

To validate their order, the Customer must enter accurate personal and delivery details to avoid any type of ordering errors. Any input errors regarding the Customer's details cannot be attributed to the Seller, and the Customer will bear the consequences in terms of delays, delivery errors, or additional shipping costs. Any order validated by the Customer implies acceptance of these General Terms and Conditions of Sale. Upon receipt of the Customer's order, a confirmation email with an order summary, which shall constitute acceptance, will be sent.

The contract between the Customer and the Seller will only be concluded once this confirmation email has been received. Payment of the order price by the selected payment method will be processed as soon as the Seller has accepted the Customer's order. The Seller undertakes to send the Customer another email as soon as the order has been dispatched.

Furthermore, the Customer must keep their contact details up to date so that the Seller can contact them regarding their order or the delivery of the Products.


4. Order cancellation

Unfortunately, the Seller can no longer cancel an order once it has been dispatched. If the Customer wishes to change their mind about their order after it has already been dispatched, they may refuse delivery or return the Products to the Seller, in accordance with the returns policy set out in clause 6 below.

5. Order verification

Before ordering Products, it is the Customer's responsibility to check and ensure that they are able to receive the ordered Products, and in particular to verify that they will easily fit into the room of their choice, that they are suitable for that room, and that no other issue is likely to complicate or prevent delivery.

ARTICLE 2: PRODUCT INFORMATION


1. Product presentation

nateoconcept.com sells furniture, textiles, and decoration accessories for baby, child, and adult environments. The characteristics of the products offered to the Customer are described precisely and with the greatest care on nateoconcept.com.
The images of Products presented on nateoconcept.com are provided for illustrative purposes only. Although the Seller makes every effort to display colors accurately, they cannot guarantee that the Customer's computer will display colors exactly or provide a satisfactory rendering of the Products' colors. As a result, the Products delivered may differ slightly from those shown in the images. Upon simple request, we will send you a color sample of the product free of charge.


2. Product availability

Items on the nateoconcept.com website are sold subject to available stock, and non-stocked Products are sold subject to availability, taking into account the applicable supply lead times at the Seller's suppliers. The availability of each product sold on nateoconcept.com is indicated on the information page of each item.


ARTICLE 3: PRICES


The price of any Product is that indicated on the nateoconcept.com website, except in the case of a manifest error. The price of any Product may change at any time, but no modification will be possible once the order has been accepted by the site's service.
The price of the Products is inclusive of VAT but exclusive of delivery costs, which are added if necessary to the price of the Products and indicated within the total amount due during the ordering process. The delivery costs for a product can be consulted in Article 5 of the General Terms and Conditions of Sale.


ARTICLE 4: PAYMENT CONDITIONS


1. General provisions

nateoconcept.com will not be required to deliver Products ordered by the Customer if the Customer has not paid the full amount under the conditions set out below. Once the amounts due have been collected by nateoconcept.com, payments made by the Customer will be considered final. If the conditions of this article are not met, nateoconcept.com reserves the right to suspend or cancel the delivery of ongoing orders for the Customer concerned.

2. Payment method

The Customer may pay for their order online by bank card (Carte Bleue, Visa, Mastercard...), by PayPal, or by bank transfer. Online payments are secured and guaranteed by Caisse d'Epargne. Nateoconcept.com ensures that no banking data passes through the online sales website by using a secure SSL (Secure Socket Layer) payment method that encrypts the Customer's banking data during transmission over the network. The Customer can verify that the transmission is encrypted by software when a padlock symbol appears in the browser's address bar. Nateoconcept.com reserves the right to request proof of identity as well as proof of address to ensure that no person is using another person's banking details without their knowledge.

3. Payment in 3/4 installments

Payment for your order in 3 or 4 instalments by credit card from €100 of purchases up to €3,000 with Alma.

Conditions:

This offer is reserved for individuals (adult natural persons) residing in France and holding a Visa or MasterCard bank card with a validity date exceeding the duration of the chosen financing. Cards requiring systematic authorization, such as Electron, Maestro, Nickel, etc., as well as e-cards, Indigo cards, and American Express cards, are not accepted.

Subscription terms:

After completing your order, simply click on the "pay in 3x 4x Alma by bank card" button. You will then be redirected to the 3x 4x Alma internet page of our partner, displaying a detailed summary of your order and the personalized financing request, which you must then validate. You enter your personal information or, if you have a 3x 4x Alma account, you log in using the credentials associated with your 3x 4x Alma account. You read the general terms and conditions for installment payments to which you wish to subscribe, which are provided in PDF format so that you can read, print, and save them before accepting them. You then confirm your electronic acceptance by checking the corresponding box.

You acknowledge that the "double click" associated with the checkbox confirming your acknowledgment of the general terms and conditions constitutes consent to contract and represents an irrevocable and unconditional acceptance of the product's general terms and conditions. Unless proven otherwise, the data recorded by Alma constitutes proof of all transactions completed between you and Alma. If you request to benefit from a financing solution offered by Alma, information relating to your order will be transmitted to Alma, which will use it to assess your request for the granting, management, and recovery of credit.

Alma reserves the right to accept or refuse your 3x 4x Alma financing request. You have a 14-day withdrawal period to cancel your credit.


For payment in 3 installments by bank card

  • 1st installment on the day of your order: 1/3 of the cart total + 1.56% of the total amount
  • 2nd installment: 30 days after your order for 1/3 of the cart total
  • 3rd installment: 60 days after your order for 1/3 of the cart total.


For payment in 4 installments by bank card

  • 1st installment on the day of your order: 1/4 of the cart total + 2.34% of the total amount
  • 2nd installment: 30 days after your order for 1/4 of the cart total
  • 3rd installment: 60 days after your order for 1/4 of the cart total.
  • 4th installment: 85 days after your order for 1/4 of the cart total.

4. Invoice

The order confirmation or the purchase order that the Customer places online does not serve as an invoice. The invoice will be sent to the Customer by the Seller if requested at [email protected].

5. Non-payment

Nateoconcept.com reserves the right to suspend or cancel any order and/or delivery in the event of non-payment of any amount owed by the customer or in the event of a payment incident. Furthermore, any order that is not fully paid for remains the property of the Seller.

ARTICLE 5: DELIVERY

1. Delivery services

Products are delivered to the address indicated by the Customer on the purchase order. The completeness and accuracy of the information must be verified by the Customer before being submitted to the Seller's service. Nateoconcept.com cannot be held responsible for any input errors and their consequences in terms of delays or delivery errors. In the event of errors, the costs incurred for reshipping the order will be entirely at the Customer's expense.

Nateo Concept cannot be held responsible for delivery delays in the event of disruptions or errors related to the carriers.


2. Dispatch timeframes

All orders placed online are processed every day from Monday to Friday (except public holidays). The nateoconcept.com team ensures order preparation within 1 to 2 business days (excluding weekends and public holidays) once the order has been validated. The carrier's timeframe below can therefore be taken into account once the shipping confirmation email has been received. In the case of an order containing one or more unavailable products, it will be dispatched once all items in the order are available. The Customer has the option of receiving available products as quickly as possible by placing unavailable items in a separate specific order. The Customer is automatically notified when their order has been dispatched.

3. Delivery timeframes

The Customer may choose their delivery timeframe by selecting the type of delivery when validating their order. The Seller provides the Customer with delivery timeframes as communicated by the chosen carrier. Shipping costs are then calculated based on the type of delivery and the location at the time of the cart and are confirmed before the final validation of the Customer's order.

4. Delivery times

When validating their order, nateoconcept.com informs the Customer of the delivery date to the Customer's home address. For a home delivery with scheduled appointment, the delivery date is confirmed upon contact by the delivery provider within 4 days following handover of the product to the carrier. Deliveries are made Monday to Saturday, subject to carrier availability and delivery zones.
The indicated delivery times are exclusive of weekends and public holidays during working days.

5. Delivery methods

Nateconcept.com offers 4 delivery methods depending on the customer's choice:

  • Delivery to your doorstep
  • Express delivery to your doorstep
  • Premium upper-floor delivery
  • Premium upper-floor delivery + assembly (Île-de-France region only)


6. Delivery delay

The Customer may contact the after-sales service directly by phone or by email in the event of a delivery delay. A dispute or investigation file will then be opened to track down the order. If a delay of 10 days is observed after the dispatch notice sent by nateoconcept.com, this implies that the Customer declares the parcels lost. Following these conditions, the Seller will handle the file and submit the necessary claims to the carrier. A period of 3 to 4 weeks may be observed following the opening of a claim with the carrier.

In the event that the parcel is found, it will be immediately forwarded to the Customer. In the event that the parcel is not found, nateoconcept.com undertakes, at its own expense, to resend the same product within the required timeframe or to fully refund the amount paid by the Customer. In the event that the product to be resent is not available in stock, the Seller will refund the amount for the product in question in this dispute.

7. Damaged parcels

The condition of the parcel must be checked by the Customer in the presence of the carrier. In the event of partial or total damage, the Customer must note the necessary reservations on the delivery slip. In the absence of any reservation by the Customer, the parcel is deemed accepted and no dispute regarding its delivery may be raised. The Customer must also inform the Seller by email at [email protected] within 48 hours of receiving the order, so that nateoconcept.com can take the necessary steps promptly.

ARTICLE 6: RIGHT OF WITHDRAWAL, RETURNS AND EXCHANGES

1. Statutory withdrawal period

Articles L.221-16 of the Consumer Code stipulate that the Customer has a withdrawal period of 14 calendar days from the date of receipt or collection of Items to notify nateoconcept.com of their intention to return said Item. The Customer exercising their legal right of withdrawal, under the conditions provided, may obtain a refund for the returned Items. Any refund will be made by the same payment method used by the Customer for the initial transaction, no later than 14 days following the effective exercise of the Customer's right of withdrawal.
Article L.221-23 of the Consumer Code stipulates that the right of withdrawal is exercised by returning the product and that shipping costs remain the responsibility of the Customer. In the event of a lack of conformity of the Items delivered with respect to the Order, transport costs will be entirely borne by nateoconcept.com.

2. Conventional withdrawal period

Nateoconcept.com wishes to ensure customer satisfaction by accepting returns by post, to the address indicated by the customer service team or on the return label of the relevant Item, within a period exceeding the statutory withdrawal period mentioned above. To this end, the Customer has fourteen (14) days from the date of receipt of their order to withdraw and return their Items. Returns of Items beyond this period will not be accepted.

3. Conditions for exercising the right of withdrawal

The nateoconcept.com team recommends that the Customer return their products by registered mail or with additional insurance coverage, guaranteeing, where applicable, compensation for the products up to their actual market value in the event of theft or loss of the goods. In all cases, returns are made at the Customer's risk. It is the Customer's responsibility to retain all proof of return. Return costs are at the Customer's expense; the Customer is free to choose the shipping method.

Failure to comply with the above-mentioned deadlines will prevent nateoconcept.com from issuing a refund to the Customer.

Only Items returned in their original packaging in perfect resalable condition will be accepted. Consequently, returns of assembled, used, or damaged Items will be refused. The right of withdrawal can never be exercised if the delivered Items have been, even partially, soiled, damaged, assembled, or used. Likewise, Items returned incomplete, damaged, or soiled by the Customer will neither be accepted for return nor exchanged. 

The Items must also be accompanied by the order number, indicated either on the return slip sent with the delivered Items and signed by the Customer, or on any other document. The Customer is informed that using the return slip facilitates the processing of the return by Nateo Concept. The Customer is therefore invited to use this return slip. The Customer's liability may only be incurred in the event of depreciation of the Item resulting from handling other than that necessary to establish the nature, characteristics and, where applicable, the proper functioning of the Items. Refunds in the event of the exercise of the right of withdrawal will be made using the same payment method as that used by the Customer for the initial transaction, unless otherwise specified by the Customer.

4. AGEC Law and 1-for-1 furniture take-back

Would you like to get rid of your old furniture? Several options are available to you.

Even better, you can donate it to a solidarity furniture collection organization, such as Emmaüs Collecte for example, which collects your old furniture directly from your home free of charge. More information at http://emmauscollecte.com/index.php/comment-faire-un-don-emmaus.

If your old furniture weighs more than 25 kg, it can be collected free of charge by one of our carriers. It must then be dismantled and properly packaged, ready to be taken away before the delivery driver arrives. As stipulated by the "1-for-1" take-back law, the item collected must be strictly of the same category as the item delivered. It must weigh approximately the same, have the same dimensions, and be of the same type. For example, if it weighs more than 25 kg, we will collect your convertible baby bed if it is being replaced by a new convertible baby bed ordered from us.

ARTICLE 7: WARRANTY, COMPLAINTS, AFTER-SALES SERVICE

1. Warranty

Article L211-4 of the French Consumer Code stipulates that the Seller's products benefit from the supplier warranty specific to each product. If the Customer is able to provide proof of a manufacturing defect, the Seller must take measures to ensure the conformity of the item with the Customer in accordance with the following articles.

"Article L.211-4 of the Consumer Code: The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was made the seller's responsibility under the contract or was carried out under the seller's supervision. Article L.211-5 of the Consumer Code:> To conform to the contract, the goods must:

  1. Be fit for the purpose normally expected of a similar item and, where applicable: - correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; - present the qualities that a buyer can legitimately expect in light of public statements made by the seller, the manufacturer, or their representative, particularly in advertising or labeling;
  2. Or present the characteristics agreed upon by both parties, or be fit for any special use sought by the buyer, brought to the seller's knowledge and accepted by the latter. Article L.211-12 of the Consumer Code: The action arising from a lack of conformity is subject to a limitation period of two years from the date of delivery of the item. Article 1641 of the Civil Code: The seller is bound by the warranty for hidden defects in the item sold that render it unfit for the purpose for which it was intended, or that so diminish such use that the buyer would not have purchased it, or would have paid a lower price for it, had they known of these defects. Article 1648 of the Civil Code: The action arising from redhibitory defects must be brought by the buyer within two years of the discovery of the defect."

The following cases are excluded from this warranty: improper use of the product or use not in accordance with its technical instructions, externally caused or incidental damage, or intervention by an unqualified repairer on the product.


2. Complaint

Any complaint must first be submitted by email or phone call to Customer Service. Contact address: [email protected] Phone: 05 46 01 49 14 Where applicable, the refund will be processed within 14 days of receipt of the Item by Nateo Concept, depending on the payment method chosen at the time of the Order. These provisions do not exclude the right of withdrawal mentioned above.

ARTICLE 8: LIABILITY

The products offered comply with French legislation in force and the standards applicable in France. The liability of nateoconcept.com cannot be engaged for inconveniences and damages related to the use of the internet network, such as in particular a service interruption, the presence of computer viruses or external intrusions, and more generally all cases qualified as force majeure or acts of third parties by the courts. Hyperlinks may redirect to sites other than the nateoconcept.com website. 

The Seller disclaims all liability in the event that the content of these sites contravenes applicable legal and regulatory provisions. The liability of nateoconcept.com may also not be engaged if the performance or delay in the performance of any of its obligations results from an event constituting a case of force majeure within the meaning of Article 1218 of the Civil Code, such as, without this list being exhaustive: natural disasters, fires, epidemics, pandemics, large-scale social movements, acts of public authority, internal or external strikes, accidental breakdowns, shortages, war, etc.

ARTICLE 9: PERSONAL DATA

Visitors or Customers of the nateoconcept.com website have the right at any time to access, modify, rectify, and delete data concerning them, pursuant to Article 34 of the Data Protection Act of 6 January 1978. When registering as a Customer or placing an order, or in the context of other specific operations, nateoconcept.com offers Visitors or Customers the option to receive its newsletters, promotional offers, and/or to register to be informed of its exclusive sales events. The Visitor or Customer may modify their subscription at any time through their personal account, or through the hyperlink at the bottom of newsletters received by email. Nateo Concept undertakes to effectively process changes to subscriptions and unsubscriptions from commercial emails sent by it as promptly as possible, depending on the processing required.

Nateo Concept uses data collection systems such as cookies. A cookie is a computer file stored on the user's computer hard drive. Cookies make it possible to record a previous visit by the user to the website and to link the user to the personal data left on the site, particularly in connection with the identification of the shopping cart.

ARTICLE 10: INTELLECTUAL PROPERTY

All elements of the nateoconcept.com website, whether visual or audio, including texts, graphics, logos and pictograms, photos and images, as well as the underlying technology, are protected by copyright, trademarks, or patents. They are the exclusive property of the company PJMD Web. Any total or partial reproduction of the PJMD Web company catalog is strictly prohibited.

Any user who has a personal website and wishes to place, for personal use, a simple link on their site directing to nateoconcept.com must first request authorization from the company PJMD Web. Authorization granted by nateoconcept.com will in no way constitute an implicit affiliation agreement and will under no circumstances be granted on a permanent basis. At the simple request of Nateo Concept, such link must be removed. Furthermore, any hyperlink directing to the nateoconcept.com website and using framing or in-line linking techniques is strictly prohibited.

ARTICLE 11: ENTIRETY OF CONDITIONS

A change in legislation, regulation, or a court decision rendering one or more clauses of these General Terms and Conditions of Sale null and void shall not affect the validity of these General Terms and Conditions of Sale. Such a change or finding shall in no way allow the Customer to disregard these General Terms and Conditions of Sale. If a condition is not explicitly mentioned, it shall be considered as governed by the practices in force in the distance selling sector for companies headquartered in France. The relationship between the company PJMD Web and the Customer is governed exclusively by these conditions, to the exclusion of any other condition appearing on the nateoconcept.com website.
